Important California Notice Regarding New Informed Consent Requirements

Dear Licensees:

Please be advised that the Board of Chiropractic Examiners (BCE) recently adopted informed consent requirements, which becomes effective October 7, 2011. California Code of Regulations, Title 16, .Div. 4, Article 2, Section 319.1 provides that:

Informed Consent:
(a) A licensed doctor of chiropractic shall verbally and in writing inform each patient of the material risks of proposed care, “Material” shall be defined as a procedure inherently involving known risk of serious bodily harm. The chiropractor shall obtain the patient’s written informed consent prior to initiating clinical care. The signed written consenf shall become part of the patient’s record.
(b) A violation of this section constitutes unprofessional conduct and may subject the licensee to disciplinary action.

In summary, section 319.1:

  • Requires all licensees to inform each patient, verbally and in writing, of the material risks of proposed care.
  • Defines “material” as a procedure inherently involving known risk of serious bodily harm.
  • Requires the licensee to obtain the patient’s written informed consent prior to initiating clinical care.
  • Provides that the signed written consent shall become part of the patient’s record.
  • Specifies that a violation of the above requirements constitutes unprofessional conduct and may subject the licensee to disciplinary action.
  • Although the regulation does not specify the manner in which written notice shall be provided to patients, you may wish to use a standardized “consent to treat” form in your practice. If you do not already use a consent to treat form and need assistance with obtaining or drafting one, you may wish to consult an attorney or contact your chiropractic malpractice insurance carrier. chiropractic colleges and associations may also be able to provide you with samples and information for developing a consent to treat form.

    116 Years Since Daniel David Palmer Healed Harvey Lillard

    Today’s date marks 116 years since the first chiropractic adjustment was given in Davenport, Iowa. On September 18, 1895, it was Daniel David Palmer (the Father of Chiropractic) making a hands on healing connection and curing a deaf janitor named Harvey Lillard. The Ryan building janitor had been plagued by years of deafness following an injury, and the hands-on thrusting and realignment of spinal vertebrae, provided a miracle today known as a chiropractic adjustment.

    Many of the words to describe what DD Palmer did on that eventful day didn’t even exist at the time, and it was an Indiana Reverend that received credit for creating the term chiropractic, around January 1896. Today, many chiropractors don’t talk of curing diseases by way of spinal adjustment, and numerous terms have been used to describe bones of the spine that are found to be slightly out of place.

    Dr. DD Palmer’s practice of magnetic healing had evolved into the science, philosophy, and art of chiropractic, and by 1902 Palmer was advertising his business in the Los Angeles Times, having moved from Iowa to the city of Pasadena (like so many others as Los Angeles was having phenomenal growth during the time). The August 1902 advertisement says…

    Chiropractics find that all illness, sickness, affections, indisposition, complaints, maladies or lack of ease are caused by some bones being slightly displaced. He therefore says:

    Why take drugs strange
    To cure disease?
    Why not adjust the frame
    And put at ease
    The feeling nerves
    Which run the human mills,
    When CHIROPRACTIC serves
    To cure all ills?

    Dr. Palmer does not treat diseases, he adjusts with his hands the displaced bones which create disease.

    We could spend days talking about what has changed in the profession and practice of chiropractic since the time of that early chiropractic marketing newspaper advertisement (it’s the first recorded advertisement in Los Angeles that I know of), but one thing remains 116 years later. The language may have changed, but there are chiropractors today, that by hand adjust displaced bones which create disease (DD’s 1902 term). There are also chiropractors that enjoy five hour work days (did you notice DD Palmer’s office hours in the advertisement?).

    Notice there’s no mention of terms like back pain, neck pain, or even headaches in the early chiropractic advertisement. The use of the term “mills” was appropriate at the time, as gold mining in nearby Mojave and Colorado deserts (also the San Bernardino Mountains) was an expanding activity. The same newspaper featured many advertisements for mining supplies available in the Los Angeles area, and active mining was taking place in what is now Joshua Tree National Park, the Mohave National Preserve, and other areas on the outskirts of Los Angeles.

    Today’s spinal subluxations are far more likely to result from habitual mobile phone and/or computer use, versus the hand grinding and milling of ore in the deserts of Southern California, but the effects on the human frame are as they were in 1895 (many chiropractors would argue that today spinal subluxations are far more devastating than those of the 1800s, when considering other toxins and traumas humans are now exposed to).

    And though it’s been some 42,340 days since DD Palmer used his hands to align the bones of a janitor afflicted with deafness, today finding a chiropractor that provides adjustment by hands, is easier than ever, thanks to our modern conveniences.     Chiropractic Equipment Classified Scams

    I’ve joked that I’ve posted on this subject 1000 times, but I’ll post 1000 more, if it helps educate people using classified advertisement websites. It’s the Internet, and scammers are everywhere (but the community is kicking butt). Users of classified advertising websites, like the chiropractic classifieds by Planet Chiropractic, would love to believe that everyone they receive e-mails from can be trusted, but that’s not the case (that goes for any classified ad website).

    Here’s two of the latest e-mail accounts (along with IP addresses) that have proven to be fraudulent accounts run by scammers intent on separating people from their money. The e-mail I received from a guy, several years ago, that almost shipped a motorcycle overseas, motivates me to continue posting information like this.

    I’d recommend to everyone not to do business with anyone contacting you from either of these two e-mail addresses. If you are selling an item on a classified ad website, and you found this post because you were doing a search to see if these contacts were fraudulent, rest assured that they are. Contact the site you have your ad posted with, and let them know you’ve been contacted by a scammer.

    Connecting Chiropractors in Los Angeles

    Two chiropractic events are taking place in Los Angeles at the end of September, with one being held on the Eastside in Pasadena, and the other on the west side in Culver City, California. They may be local events to those practicing in the Los Angeles area, but chiropractors are traveling from across the country to come speak at the Friday Saturday event in Culver City.     The second event is a two day chiropractic philosophy seminar that begins on Friday, September 30, and goes through Saturday, October 1. It’s hosted by Dr. Phil Yamamoto (seen on right side of above photo) and it’s taking place at West LA’s Doubletree by Hilton Hotel Los Angeles.     Chiropractic Connect Conference came about because of the need for quarterly Principled Chiropractic Philosophy meetings with a home on the West Coast. Connect would like to publicly acknowledge and thank Dr. Billy DeMoss from Cal Jam in helping plant the seed for Connect.

    At this last Cal Jam in February 2011, Billy and I had discussed the need for regular chiropractic philosophy meetings here in Southern California. Billy jokingly suggested that I run with the idea, in that I wasn’t a very busy guy and had lots of free time on my hands. Anyone who knows me, knows that I’m a very busy guy, but it’s the guys who are busy who get things done. If you ever need anything done, don’t ask a guy with lots of time on his hands, it won’t get done.

There are some chiropractic philosophy meetings that don’t like to integrate or discuss the business side of practice in that they think it’s not pure. We can appreciate their opinion, but don’t agree in that there are way too many chiropractors who are struggling in practice because they don’t know what it is that they are supposed to be doing in practice.

    There are plenty of chiropractors who know chiropractic philosophy forwards and backwards, but recite the Green Books all day long to an empty office. Chiropractic philosophy is an ABSOLUTE necessity, but this alone will not guarantee a strong principled chiropractic practice.
